Illegal arrest of Constitutional Attorney Katherine Henry on Election Day, November 3, 2020. Is your public official willing to be arrested to defend the Constitution? This one is! Constitutional Attorney Katherine Henry stood her ground to circulate her petition on public property during business hours on election day (about 1,000 feet away from the door to the polls), while these law enforcement officials and township officials ignored both state law and the Constitution.

On Election Day, 11/03/20, Allegan County Sheriff deputies threatened to arrest of circulators that were collecting signatures at Leighton Township Hall-Library for the Restore Freedom Initiative constitutional amendment petition. Katherine spoke with deputy Langlois on the phone and after realizing he still gravely misunderstood the law, she offered to come discuss the law with him at the township hall, to which he agreed.

As the lead attorney for RFI, Katherine arrived at the Leighton Township town hall / library to find deputy Langlois had left to answer another call. She waited there with the circulators for him to return. Upon returning, he had no interest in discussing the law, instead he was insistent that they leave the property immediately. This is that interaction and the arrest.

“Today I am going to interview Katherine Henry regarding her unlawful arrest on Election Day 2020 and the “Constitutional catastrophe” the case turned into.

Katherine authored a constitutional amendment petition (Restore Freedom Initiative) and had set volunteers up to collect signatures on election day at various polling locations. She gave volunteers the necessary laws and information for collecting signatures at a polling place on Election Day. At the Leighton Township precinct in Allegan County, Michigan, she had volunteers being threatened with arrest. The clerk claimed that a township resolution gave her that authority.

Sheriff Deputy Langlois was on scene with the circulators and ended up speaking to Katherine on the phone but there was confusion. As the lead attorney for the campaign, she offered to drive down there (30+ mins from her home) to discuss the law with him and he agreed.

Deputy Langlois wasn’t there when she got there, but arrived shortly after and wasn’t really interested in discussing the law with her. That’s where we see the video begin.

She was handcuffed and thrown into the car, but released later, after having a conversation with Sheriff Baker (Sheriff for Allegan County) on one of the deputy’s cell phones and because of the many stream viewers that were calling in. She was given a civil infraction ticket charging her with Michigan’s trespass code – MCL 750.552 that the deputy Langlois changed to a criminal citation before turning in.

The case was dismissed with prejudice only after it became more clear to the judge that Katherine was not physically parked on the parking lot, but in the grass.”

“You shall not pervert the justice due to your poor in his lawsuit.” Exodus 23:6.

This week, my Allegan County Election Day 2020 “Trespassing” case was FINALLY dismissed! While I am grateful that God allowed us to close out that chapter of our lives, it took 1 year, 8 months & 5 days; over $6,000 in transcript fees & appellate costs; over 10,000 miles of traveling to the Allegan Courthouse; 19 Motions & 5 Appeals; thousands of pages filed; hundreds of statutes, court rules, cases & Constitutional provisions cited; dealing with 5 Prosecuting Attorneys, 2 District Court Judges & 2 Appellate Judges; thousands of hours of legal research & writing; 11 court hearings; many days off work for Mike; etc to see this justice done. And this still does not make me whole for the countless signatures the RFI petition lost; the many bruises, contusions, cuts, abrasions, etc that I suffered at the hands of those 3 Sheriff’s Deputies; the lasting emotional trauma that both I and my then 6 year old daughter Emma have suffered; nor the loss of faith in “the system” by myself and thousands of others for how this incident went down & how the judges and prosecutors continued the law violations for the near 2-year span of time. Although I finally “prevailed” in this criminal case, several government officials did everything they could to “pervert the justice due” to me – a homeschooling mom who donates 100% of her professional time to educating & empowering We The People. Mike & I are far from wealthy, and the court system routinely “perverts justice” for others similarly situated & many with even far less resources. This type of lawless, Godless behavior must NOT be tolerated! Allegan County Election Day 2020 Case Filings

Katherine’s Allegan County Election Day 2020 Case has spanned from 11/3/20 to the present, for a total of more than 19 months as of today! The trial is currently scheduled for Motion Hearings & a Settlement Conference on 7/7/22 with the Jury Trial on 7/13/22… But, this is the 8th trial date the court has given, so it is unsure whether it will be moved yet again.

Katherine initially filed a Motion to Dismiss, which was heard by the court on 2/4/21. When the court denied her Motion, and violated several other rights she has, Katherine filed 2 Interlocutory Appeals in the Circuit Court in the Spring of 2021. When the Circuit Court denied those appeals, Katherine filed them in the MI Court of Appeals, which chose not to take on those appeals at that time. With the June 15, 2022 Trial Date approaching, Katherine filed several Motions in the trial court in May 2022 in order to secure her rights. Those were set to be heard by the trial judge on 6/2/22, but the Judge moved the hearing on those motions to 7/7/22.

The legal arguments in Katherine’s documents from this case can be used by others in their own fights for freedom, or even just to educate themselves or others on general Constitutional topics.
