(The following is the description from the original video of this interview posted by Tim Brown.) Constitutional attorney Katherine Henry was called to explain the law to Allegan County, Michigan sheriff’s deputies on Election Day 2020 due to a complaint filed by the clerk at the precinct claiming that people gaining signatures under the protection of the law were somehow violating the law. She drove to the precinct only to have three of the modern day brownshirts of the sheriff’s office bully and manhandle her, ultimately arresting her without obeying the law themselves. After a short time, she was released but has been an ongoing and expensive court battle in which tyrannical judges won’t even allow her to use the law as her defense and have destroyed court video records of her hearings. Each of the brownshirts, as well as the judges, are engaged in such criminal behavior that it can bring a penalty up to and including death. She joins me in this episode to tell her story prior to her hearing on Wednesday, July 21-2021.

Access may be denied for property NOT ordinarily open to the public, but may NOT be denied to property “open to the public generally” unless the excluded person is 1) obstructing normal operations or 2) interfering with others’ rights of normal use of the property. People so excluded could be charged with disturbing the peace, usually under MCL 750.167 or 750.170. But, regardless of ownership, members of the general public may NOT be excluded from property open to the general public “through the use of trespass laws.” If you are not impeding normal operations or directly interfering with the rights of others, you are NOT disturbing the peace; and if on property open to the general public, you are NOT trespassing, nor may you be excluded through criminal trespass laws.

Constitutional Attorney Katherine Henry stood her ground to circulate her petition on public property during business hours on election day (about 1,000 feet away from the door to the polls), while these law enforcement officials and township officials ignored both state law and the Constitution.

Compilation of various viewpoints of the illegal arrest of Constitutional Attorney Katherine Henry in Leighton Township by Allegan County Sheriff Deputies on Election Day 2020. Katherine Henry was called to the scene by an Allegan County Sheriff Deputy as the attorney representing the Restore Freedom Initiative Petition volunteers. Instead of speaking to her about the law when she got there, they violently and illegally arrested her, threatening to impound her car and put her 6 year old daughter (with her that day) into the CPS system.

Restore Freedom Initiative circulators collecting signatures at Leighton Township Hall during the 2020 election were threatened with arrest. After calling Katherine regarding the threat, she spoke with Deputy Langlois where it became clear an in-person discussion was needed. Deputy Langlois agreed. Katherine went to the Leighton Township Hall property where circulators were well beyond the 100′ from the entrance, required by Michigan election law.
