Freedom Fighter Phocion Denied Due Process! – Constitution Segment Recap S2E18

Innocent people are prosecuted EVERY DAY, so it’s important for you to know your rights. This week’s #GetInvolvedChallenge is to identify the 6 protections within the 6th Amendment.
T/F Tuesday Answer: TRUE! Although FR Crim Pro 10(a) requires the charges to be read to you AT the arraignment (not before), Due Process (5th & 14th Am) requires the govt to give you adequate Notice & Opportunity to be heard, which means the charges must be included in the Notice to Appear for Arraignment. Additionally, the 6th Am guarantees you the right to be informed of the nature and cause of the accusation against you. #ConstitutionMatters
The government says you’ve committed an “offense” and must appear for court. Everyone knows this requires you to be given Due Process of law. That includes providing you with Notice of when & where the hearing is, which judge will preside, if the charges are civil or criminal, what law they allege you broke, & the court file number (so you can file responses & motions you deem necessary). But our Freedom Fighting friend Phocion is being denied this Due Process! In this episode, Katherine & Phocion will discuss this case, Phocion’s 5/16/23 Hearing, & his legal options!

Whether you have an upcoming trial, evidentiary hearing, or motion hearing, it’s important to understand the basics. This week’s #FreedomFightingTools are cheat sheets to help you write legal arguments (wp.me/aecX6i-2qs), understand basic principles of government and the Constitution (wp.me/aecX6i-2qt), & see main aspects of intentional torts (most common civil cases other than contracts and family law; wp.me/aecX6i-2qu).

What we are watching and what you need to know
There continues to be a lot happening in the health freedom sphere. Rest assured that we’re closely watching and listening on all fronts and all levels of government. This past week, we tuned in to the following hearings to understand any implications for health freedom. We’ll be in touch if action is needed!
The CDC’s Advisory Committee on Immunization Practice (ACIP) met to discuss updates on COVID-19.
The Congressional Appropriations Committee held a budget hearing to look at the fiscal year 2024.
A joint congressional subcommittee held a hearing on the data breach at the D.C. Health Exchange.
In the meantime, we wanted you to know about this recent exciting win for our movement, that you can try to emulate in your city.
Florida’s Collier County Board of Commissioners is on a roll! Fresh from taking a stand for their autonomy by refusing a CDC grant with strings attached, these freedom supporters took an additional step on April 11, by passing an ordinance and a resolution to further protect health freedom.

And their success can fuel yours! In addition to celebrating this win with them, you can use their health freedom bill of rights as a template to craft a similar ordinance for your county.
Freedom begins at home – in the schools, organizations, cities, and counties where we live, work and play. If we all take a stand locally, we can change the whole country!

Whether you have an attorney or not, it’s important for you to understand the differences between Trials, Evidentiary Hearings, and Motion Hearings. So, this week’s #GetInvolvedChallenge is to watch/listen to an example Evidentiary Hearing (restorefreedomkh.com/3lcq) and regular Motion Hearing (restorefreedomkh.com/GIC17) & identify the differences between them.
T/F Tuesday Answer: FALSE! Although testimony is a given at Evidentiary hearings, most Motion hearings do not have testimony or evidence presented, rather, just legal argument from each side.
The Washington Examiner, which publishes political news and conservative analysis, published an article about the recent drive-by news article done by the Washington Post.
The Washington Examiner article by Mike Gonzalez, senior fellow at the Heritage Foundation, accurately describes the “strategy” of the political left, which is to fundamentally change American society and label anyone who thinks differently (especially conservative leaders) as obnoxious, polarizing, and extreme.
Mr. Gonzalez describes it this way: “The woke would prefer it, of course, if we all just lay low” and allow their “cultural bulldozer” to flatten conservative values. “All this is playing out in Ottawa.”
Read the Article |
The story of everyday Americans taking back this county from tyrannical bureaucrats and woke politicians is spreading.
The principled actions of the most diverse Board of Commissioners in the history of Ottawa County is being shared across the country.
Be prepared!
The biased local news, and now national news, will continue to attack. The attacks will intensify as local leaders stand on the courage of their convictions.
This is what the progressive left fears: conservative leaders who actually do what they say they will do, and use the Constitution and traditional American values to guide their decisions.
Be encouraged!
Ottawa County is filled with Americans who will defend against the “cultural bulldozer” trying to flatten conservative values.
